Carpark Rental Agreement

A neutral-form agreement granting a licence to use a car parking space in England & Wales. It is drafted as a licence, not a lease.

How to use this template - Replace every [SQUARE-BRACKET] field before use. - This is a licence (permission to use the space), not a tenancy. To keep it a licence, the user should not be given exclusive possession of a defined space to the exclusion of the owner, clause 2 and clause 6 are drafted with that in mind. If the arrangement in practice gives exclusive possession, a court may treat it as a tenancy regardless of the label. - Have a solicitor review before use, especially if the space forms part of larger premises.

Agreed terms

1. Licence. The Licensor grants the Licensee a personal, non-exclusive licence to park one private motor vehicle at [CAR PARK ADDRESS / SPACE REFERENCE] (the "Car Park") during the Permitted Hours, in return for the Licence Fee.

2. No tenancy. This licence does not grant the Licensee exclusive possession of any part of the Car Park or any estate or interest in land, and does not create a tenancy. The Licensor may, acting reasonably, allocate or re-allocate spaces.

3. Term. This licence runs from [START DATE] [for [PERIOD] / until ended under clause 7].

4. Licence Fee. The Licensee will pay £[AMOUNT] per [week/month], in advance, by [PAYMENT METHOD], on [DATE/FREQUENCY].

5. Permitted hours and use. The Licensee may use the Car Park [at all times / between [HOURS]] only for parking a private vehicle, and not for repairs, storage, trading or any unlawful or hazardous purpose.

6. The Licensee's obligations. The Licensee will: park considerately and not obstruct others; comply with the Licensor's reasonable parking rules and signage; keep the space tidy; not assign or share the licence; and hold valid insurance and a roadworthy, taxed vehicle.

7. Termination. Either party may end this licence on [NUMBER] days' written notice. The Licensor may end it immediately if the Licence Fee is [NUMBER] days overdue or the Licensee seriously breaches this agreement.

8. Liability. The Licensee parks at their own risk. Nothing in this agreement excludes liability that cannot lawfully be excluded (including for death or personal injury caused by the Licensor's negligence). Subject to that, the Licensor is not liable for loss of or damage to the vehicle or its contents except to the extent caused by the Licensor's negligence.

9. Governing law and jurisdiction. This licence is governed by the law of England and Wales, whose courts have exclusive jurisdiction.
