Employee Termination Letter / Employment Termination Letter

Employee Termination Letter / Employment Termination Letter

A template letter from an employer to an employee confirming the termination of their employment, for use in England & Wales.

⚠️ Follow a fair process first. A termination letter is the last step, not the first. Where the employee has the qualifying service, you must have a fair reason and follow a fair procedure before dismissing, or you risk an unfair dismissal claim. Note: some protections apply from day one regardless of length of service, including discrimination claims and certain automatically unfair dismissals (such as dismissal connected to whistleblowing, pregnancy or family leave). The ACAS Code of Practice on disciplinary and grievance procedures applies principally to conduct and capability dismissals; redundancy and expiry of fixed-term contracts require fair processes but are not generally governed by the ACAS Code in the same way. Give the correct notice (statutory or contractual), and only dismiss without notice for genuine gross misconduct.

How to use this template - Replace every [SQUARE-BRACKET] field before use, and select the wording that matches the reason for termination. - Take advice before dismissing, especially for conduct, capability or redundancy.
