Employment Agreement (Junior Employee)

An employment agreement between a company and a junior employee (without share options), drafted in favour of the Company, governed by the law of England & Wales. It is designed to satisfy the written-statement requirements of the Employment Rights Act 1996.

BETWEEN (1) [COMPANY NAME] (company no. [NUMBER]) of [ADDRESS] (the "Company"); and (2) [EMPLOYEE NAME] of [ADDRESS] (the "Employee").

Agreed terms

1. Appointment and start date. The Company employs the Employee as [JOB TITLE] from [START DATE]. No previous employment with the Company counts towards continuous employment, unless continuity is preserved by law (for example, on a business transfer). The first [NUMBER] months are a probationary period, during which notice is [NUMBER] week(s).

2. Duties. The Employee will carry out the duties of the role and other reasonable duties, comply with Company policies, and devote their full working time to the Company.

3. Place and hours of work. Place of work: [LOCATION]. Normal hours: [HOURS] per week, [DAYS/TIMES]. [Overtime arrangements: [DETAILS].]

4. Pay. Salary of £[AMOUNT] per year, paid monthly in arrears, [reviewed annually with no obligation to increase]. Pay is at least the National Minimum/Living Wage for the Employee's age.

5. Pension and benefits. The Employee will be enrolled in the Company's workplace pension in line with auto-enrolment. [Other benefits: [DETAILS].]

6. Holiday. [NUMBER] days' paid holiday per year [inclusive of / plus] bank holidays, accruing pro rata, to be taken with prior approval.

7. Sickness. The Employee must notify absence by [TIME] to [CONTACT]. Statutory Sick Pay applies [plus any Company sick pay as in Schedule 1].

8. Confidentiality and intellectual property. The Employee will keep Company and client information confidential during and after employment. To the extent provided by law and/or under this Agreement, intellectual property created by the Employee in the course of employment will belong to or be assigned to the Company, and the Employee will sign any document needed to confirm or perfect that ownership.

9. Deductions. The Employee authorises the Company to deduct from pay any sums lawfully owed to the Company (such as overpayments or unreturned property), to the extent permitted by law.

10. Notice and termination. After probation, either party may terminate on [NUMBER] week(s)' notice (or the statutory minimum if greater). The Company may dismiss without notice where the Employee's conduct amounts to a repudiatory breach justifying summary dismissal at law, subject to following a fair procedure where required.

11. Post-termination. For [NUMBER] months after leaving, the Employee will not [solicit Company clients / poach staff] to the extent reasonably necessary to protect the Company's legitimate interests.

12. Governing law and jurisdiction. This Agreement is governed by the law of England and Wales, whose courts have jurisdiction.
